1. Acceptance of Terms
By adding Barry’s Bot (hereinafter "the Bot") to a Discord server, installing it on your personal profile, or using it within any context, you (hereinafter "the User" or "Server Owner") agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately remove the Bot and cease all interaction with it.
2. Eligibility and License
Compliance: You must comply with the official Discord Terms of Service and Discord Developer Terms of Service at all times when interacting with the Bot.
License: The Bot is provided free of charge for personal, non-commercial, and community use. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Bot.
3. Acceptable Use
You agree not to abuse, exploit, or disrupt the Bot’s infrastructure or functionality. Prohibited activities include, but are not limited to:
- Spamming commands, trying to bypass security verifications, or generating excessive traffic to API endpoints.
- Attempting to reverse-engineer, decompile, exploit bugs, or extract data from the Bot's hosting platform.
- Using the Bot or its administrative tools to harass, abuse, self-harm, or violate the rights of other users.
4. Administrative and Staff Commands
Certain commands require specific moderation permissions inside your guild (such as /purge, /dm, /announce, and starting/ending /gtn games). These require the user to possess the Manage Messages permission.
Responsibility for Commands: The Server Owner and designated staff members are solely responsible for how these administrative commands are utilized within their community.
DM Command Disclaimer: Direct messages sent to users using the /dm command are initiated dynamically by your server's staff. These messages carry a clear footer stating "Not an official Barry's Bot message" to notify recipients that the content represents moderation decisions made by local server staff, not the developer of Barry's Bot.
Misuse: The developer of the Bot cannot be held responsible for accidental data loss (e.g., deleted messages via /purge), server disruptions, or misuse of administrative functions by server staff.
5. Disclaimer of Warranties
The Bot is provided on an "as is" and "as available" basis. The developer is an individual hobbyist and does not guarantee uninterrupted uptime, error-free operations, or that specific features will remain permanently available. The Bot may go offline at any time without prior notice for maintenance, technical updates, or due to hosting, network, or external API issues.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the developer of Barry’s Bot shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of data, server disruption, loss of profits, emotional distress, or financial damages resulting from:
- The use or inability to use the Bot.
- Any bugs, glitches, or errors within the software code.
- The termination or suspension of your access to the Bot.
7. Modifications and Termination
Changes to Terms: The developer reserves the right to modify these Terms at any time. Continued usage of the Bot after updates are published constitutes explicit acceptance of the revised Terms.
Termination: Access to the Bot may be suspended or terminated for any user, server, or system integration at any time, without prior notice, for any reason, including a breach of these Terms.
8. Governing Law
These Terms of Service and any disputes or claims arising out of your use of the Bot shall be governed by and construed in accordance with the laws of the Netherlands.
